Selling Conditions

1 - Introduction

1.1  The following General Terms and Conditions of Sale (hereinafter referred to as "GCS") govern all purchases of products offered on the website www.lorencomfortstore.com (hereinafter referred to as the "website").

2 - Identification of the seller

2.1  Loren s.r.l.

Limited liability company, with registered office in Via G. Pastore no. 20 - Montebelluna (TV) - Italy, enrolled in the Treviso Register of Companies and VAT no. 00317960268, enrolled in R.E.A. Treviso no. 114377 (hereinafter referred to as “Loren”)

3 - Scope

3.1  Our products offered for sale on the website are only directed to "customers-consumers" i.e. natural persons who purchase products for purposes unrelated to their business, commercial or professional activity (hereinafter referred to as "Customer").

3.2  Our offers are aimed exclusively at customers who have delivery address in Italy, with the exception of Livigno, Campione d'Italia and P.O. Boxes and Poste Restante and in Europe with the exception of Switzerland, Corsica, the Azores, Madeira and the smaller islands.

3.3  Loren reserves the right to change the prices of items sold through the website at any time or supplement these GCS. Any changes and/or new conditions will come into force from the moment of publication on the website. Customers are therefore invited to consult the updated version of the GCS before making any purchase. The applicable GCS are therefore those in force on the date the purchase order is sent.

3.4  By sending the purchase order, which has the value of a contractual proposal, the customer confirms acceptance of these GCS.

4 - Purchase procedure

4.1  The customer has the possibility to view the product of their interest on the page of the website where, in addition to the photographig images that allow an adequate representation, there is also a detailed description of the product, the price (including taxes) and the available colors and sizes.

4.2  The customer will proceed with the purchase by entering the item(s) of interest in the "Shopping Cart"; there you will find a photo of the selected product, a short summary of the description including sizes, the final cost, eventual shipping costs and the possible payment method.

4.3 The customer, before sending the purchase order, is required to verify the content of the Shopping Cart and confirm that he has read and accepted these GCS.

4.4  Loren will confirm the correct receipt of the contract proposal by means of an automatic system response, which will be sent to the e-mail address indicated by the customer. Loren will also provide an Order Number which must always be indicated in subsequent communications.

4.5  The order's shipment confirmation by Loren, by e-mail, will constitute acceptance of the contractual proposal and the purchase contract can be considered concluded. Loren, at its own discretion, reserves the right to accept or not the contractual proposal sent by the customer, without the latter being able to make claims or rights of any kind, for any reason, including compensation, in case of non-acceptance of the order itself.

5 - Representation and availability of the products

5.1  It is our care and commitment to make sure that the photographs represeting the products on sale are a reproduction of the real product as faithfully as possible, however, due to the technical characteristics and/or screen resolution of the customer, differences in the representation of the product may occur. Due to these differences due to technology and not directly controllable, we do not assume anny responsability and cannot guarantee absolute correspondence to reality with particular reference to colour shades, type of leather, printed leather effects and actual dimensions.

5.2  The customer, on the page of the chosen product, will find the available sized. However, due to the possible simultaneous acces to the website and choice of the same product by several customers, the actual availability may not be updated. In this case the customer will be promptly informed by e-mail or telephone and can choose whether to order a different item or cancel the order. Loren does not guarantee the certainty of delivery of the products purchased, even if indicated as available on the website and therefore will, in no case, be responsible for failure to process the order.

6 - Pricing

6.1  The prices of the products on sale on the website are expressed in Euros and include taxes. The price does not include shipping costs. Loren reserves the right to change prices at any time without notice.

6.2  On the "Shopping Cart" page the customer will find an indication of the total amount, given by the price of the product and any shipping costs.

7 - Payment and delivery

7.1  Loren accepts the following means of payment:

  1. Payments made through the secure PayPal system. With this payment system teh customer will be redirected to www.paypal.it where they will make the payment according to the procedure and the terms of contract agreed betewwn the user and PayPal. The data entered on the PayPal website will be processed directly by the same and will not be transmitted or shared with Loren. Loren is therefore not able to know in any way the data of the credit card connected to the user's PayPal account or the data of any other payment instrument with such account.
  2. Visa, MasterCard or Maestro credit cards
  3. Bank transfer
  4. Cash on delivery

Once the payment was made the customer confirms definately and irrevocably the order.

7.2  The total amount due will be charged by PayPal or Credit Card to the customer at the conclusion of the online purchase procedure. In case of non-acceptance of the purchase proposal by Loren, the refund amount due to the customer ("Refund Amount") will be credited to the account of the used card. The credit times depend exclusively on the Credit Cards and the banking system. Once the credit order has been placed in favour of the relevent account, Loren cannot be held responsible for any delays or omissions in crediting the customer with the refund amount, to which the customer must apply directly to the credit cards.

7.3  Loren, exept as provided for in pint 5.2, will ship the ordered item within 5 (five) workdays following confirmation of receipt of the order. For deliveries Loren will use a carrier or our choice. Delivery times by the courier range from 2 to 6 days, depending on the location.

7.4  Eventual shipping costs are indicated in the Shopping Cart, therefore visible before confirmation of the order and in the purchase order summary page.

7.5  As indicated in point 4.5, at the same time as the shipment of the order, Loren will send the customer an e-mail to confirm the shipment of the order. If the customer, after 10 working days ffrom receiving this confirmation, should not receive the package, they are invited to report the delay to the e-mail address indicated below.

8 - Right of withdrawal and Refund

8.1  In accordance with the provisions of the Consumer Code (D. Lgs 206/2005) and subsequent amendment (D. Lgs 21/2014), the customer has the right to exercise the Right of Withdrawal, without having to specify the reason. The period provided by the Italian law is 14 days from the date of delivery of the product. Within this period, to exercise the right, te customer must send to Loren srl a Notice of Withdrawal by e-mail to customer@loren.it indicating the willingness to make use of the Right of Withdrawal, the details of the order and the product for which you intend to exercise the withdrawal and wait for an e-mail with the procedure to follow and the return authorization number. The customer shall return the products at his own expense and risk by choosing his trusted courier.

8.2  Conditions to exercise the Right od Withdrawal:

  1. The good must be intact, unused, in perfect shape and returned in the original box, complete in every part, complete in all its parts including any leaflets and labels, where present, still attached to the product, as well as the other elements of the offer (for example gadgets) and properly packed and protected to avoid damage during shipment;
  2. The risks of shipping (destruction, damage of loss of the products), until the certificate of receipt at our premises, are borne by the customer, it being understood that in this case, the products will not be considered intact and the withdrawal will not be effective. For this purpose it is recommended to insure the shipment. In case of damage of the goods during transport, Loren s.r.l. will give notice to the customer, to allow him to make a timely complaint against the courier chosen by him and obtain a refund;
  3. The shipping cost (and customs charges, if any) for the return of the goods will be at the exclusive expense of the customer. We remind you that, if you purchased through PayPal, there is the possibility to request reimbursement for the expenses incurred. More information on the PayPal website.
  4. Loren s.r.l. will not be liable in any way for damage, theft, loss occured during or in connection with the shipment of the return.

8.3  Loren, after verifying the conditions listed in point 8.2, will refund the price of the product in the same manner in which the payment was made at the time of the order. The amount credited does not include any shipping costs.

8.4  Loren reserves the right not to accept the return of products that are returned in a different manner than indicated in the authorization mail, in particular no package will be accepted with cash on delivery or carriage forward.

8.5  Loren, upon receipt of the package, will verify that the product is actually in original and perfect condition. In case:

  • the product is damaged or dirty or the original internal of the packaging of the product is missing;
  • The product is missing integrating elements, such as accessories, laces, etc., and/or gadgets supplied as part of the offer;

The exercise of the Right of withdrawal will be ineffective and the product will be returned to the customer at Loren's expense without the customer being able to claim any refund.

9 - Size change

9.1  It is possible to return the product to get a different size of the same article if it is available. It is not possible to change the product with a different article. To change the size you must send an e-mail to customer@loren.it within two days of receipt of the product, indicating the desired size and wait for an e-mail confirming the availability of the requested size, the procedure to follow and the return authorization number.

9.3  All the conditions indicated in the paragrapghs 8.2, 8.4 and 8.5 remain valid, exept for the refund of the price of the product. It should be noted, in particular, that the costs for the return of the product and the responsibility for shipping are fully borne by the customer, while the shipment of the product in the new size will be borne by Loren.

9.4  In case of unavailability of the required size, the customer may proceed as per point 8.

10 - Warranty

10.1 Upon delivery, the customer must check the integrity of the shipment. In case of anomalies (e.g. damage or tampering of the packaging, missing items, etc.) the customer must sign the transport document "subject to control"; highlighting the reason and send an e-mail to customer@loren.it withing 24 hours of receipt of the goods.

10.2 Products sold by Loren are covered by the Legal Warranty of Conformity provided by the consumer code (d. lgs. 206/2005). The guarantee of conformity of the product is valid on condition that the defect becomes apparent within 24 months from the date of delivery and that the customer makes a formal complaint within a maximum period of 2 months from the date on which they discovered the defect. In order to benefit from the legal warranty, you must therefore provide proof of the date of purchase and delivery of the goods by keeping the delivery documents or by presenting any other document that can attest to the date of purchase.

10.3 Any breakage or defect caused by normal wear and tear of the product, by accidental events or by the user's responsibility, or by a use of the product that does not comply with its intended use and/or with the provisions of the documentation attached to the product are excluded from the scope of application of the Legal Warranty of conformity.

10.4 In order to better assess that the complaint does not fall within the cases mentioned in point 10.3, Loren reserves the right to ask the customer for a detailed description of the nature of the problem and, if necessary, for photographic evidence of the defect.

10.5 In case of defect, the customer has the right to restore, without further expenses, the conformity of the product, by repair or replacement. If this is not possible, they have the right to an adequate reduction of the price (in case of light defects) or the right to withdraw from the contract. If the customer's chosen remedy results too expensive to Loren, we may decide to restore the conformity of the product in the less expensive manner.

10.6 To return the product the customer must follow the instructions and indicate the return number, which they will receive via e-mail by the customer support. Eventual non-authorized returns or returns that have been sent with a non-indicated courier will not be accepted.

11 - Tax

11.1  In accordance with DPR n. 633 of the 26/10/1972 art. 22 Loren, as an online seller, is exempt from the issuance of a receipt and invoice if not expresly requested by the customer before processing the order.

12 - Privacy

12.1  Reguarding the processing of personal data, please refer to what is indicated in the "Privacy Policy" viewable on the Website.

13 - Jurisdiction

13.1  The General Conditions of sale are regulated by Italian Law and for any controversy the juridical authority of the place indicated by the customer as his residence will be competent, if located in the territory of the Italian State.
